By placing an order through this website, you declare to be over 18 years old and have legal capacity to conclude contracts.

  1. PROVISION OF SERVICE

Items offered through this website are available for shipment to any country.

  1. CONTRACT

The information contained in the present Conditions and the details contained on this website do not constitute a sale offer, but an invitation to hire. There will be no contract between you and us in relation to any product until your order has been expressly accepted by us. If your offer is not accepted and any charges have already been made in your account, the amount of the offer will be refunded to you in full.

To place an order, you must follow the online shopping procedure and click on "Authorize payment". After this, you will receive an email accusing receipt of your order (the "Order Confirmation"). Note that this does not mean that your order has been accepted, as it is an offer that you make us to buy one or more products. All orders are subject to our acceptance, which you will be informed through an email in which we confirm that the product is being shipped (the “Shipping Confirmation”). The contract for the purchase of a product between you and us (the “Contrate”) will be formalized only when we send you the Shipment Confirmation.

Only those related products in the Shipment Confirmation will be subject to the Contract. We will not be obliged to supply you with any products that may have been ordered until we confirm your shipment in a Shipment Confirmation.

  1. PRODUCTS

All product orders are subject to the availability of the same. In this regard, if there are difficulties in the supply of products or if there are no items in stock, we reserve the right to provide you with information about substitute products of quality and value equal or higher that you can order. If you do not wish to order those replacement products, we will refund you any amount you might have paid.

  1. BETWEEN

Without prejudice to the provisions of Clause 7 above regarding the availability of the products and unless there are extraordinary circumstances, we will try to send the order consisting of the products related to each Confirmation of Shipping before the date of delivery contained in the Confirmation of Delivery in question or, if no delivery date is specified, within 1 working day of the date of Confirmation of Delivery.

However, delays could occur for any of the following reasons:

    1. unforeseen circumstances; or
    2. delivery area;

If for any reason we cannot meet the date of delivery, we will inform you of this circumstance and give you the option to proceed with the purchase by establishing a new delivery date or cancel the order with the full refund of the paid price. Please note in any case that we do not deliver on Saturdays or Sundays, except in the case of the virtual gift card, which will be delivered on the date indicated by you.

For the purposes of these Terms, it will be understood that the "delivery" has occurred or that the order has been delivered at the time of signing the receipt of the same in the agreed delivery address, although the virtual gift card, will be understood to be delivered in accordance with the terms of use of the Gift Card, and in any case, on the date of sending it to the email indicated by you.

  1. TRANSMISSION OF RISK AND PROPERTY

The risks of the products will be borne by the time of delivery.

You will acquire the ownership of the products when we receive the full payment of all the amounts due in relation to the same, including the shipping costs, or at the time of delivery (according to the definition contained in the previous clause), if this occurs at a later time.

  1. PRICE AND PAGO

The price of each product will be the one that is stamped at every moment on our website, except in case of manifest error. Although we try to make sure that all the prices on the page are correct, mistakes can occur. If we discover an error in the price of any of the products you have ordered, we will inform you as soon as possible and give you the option to reconfirm your order at the right price or cancel it. If we fail to contact you, the order will be considered cancelled and refunded in full the amounts paid.

We will not be obliged to supply any product at the wrong lower price (even if we have sent you the Shipment Confirmation) if the error in the price is obvious and unequivocal and could have been reasonably recognized by you as an incorrect price.

The prices of this website include VAT, but exclude shipping costs, which will be added to the total amount due as set out in our Shipping and Handling section.

Prices may change at any time, but (except as set out above) possible changes will not affect orders regarding which we have already sent you a Shipment Confirmation.

Once you have made your purchases, all items you wish to purchase will have been added to your shopping cart and the next step will be to process the order and make the payment.

You can pay with Visa, Mastercard, and PayPal cards. By clicking on "Authorize Payment" you are confirming that the credit card is yours.

Credit cards shall be subject to checks and authorizations by the issuing entity of the same, but if such entity does not authorize payment, we shall not be liable for any delay or lack of delivery and we shall not be able to formalize any Agreement with you.

  1. VALUE ADDED TAX

In accordance with article 68 of Law 37/1992 of 28 December, of the Tax on Value Added, the delivery of the articles will be understood to be located in the territory of application of Spanish VAT if the delivery address is in Spanish territory except Canary Islands, Ceuta and Melilla. The applicable VAT rate will be legally applicable at each time.

In the orders for the Canary Islands, Ceuta, Melilla and Andorra, the deliveries will be exempted from VAT pursuant to article 21 of Law 37/1992, without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of these territories.

  1. POLICY OF CHANGES/DEVOLUTIONS
    1. Legal right to withdraw from the purchase

In accordance with the applicable regulations, if you are contracting as a consumer, you may withdraw from the Contract at any time within 7 working days from the date of delivery of your order.

In this case, you will be refunded the price paid for such products. You will take care of the direct costs of returning the product when you do not return for any of the free methods mentioned in the following clause.

You may credit the exercise of the right of withdrawal in any form admitted in law, considering in any case validly exercised such right by sending the withdrawal document we provide you or by returning the products.

This provision does not affect other rights recognized to the consumer by existing legislation.

Your right to withdraw from the Contract will apply exclusively to those products that are returned in the same conditions in which you received them. Please return the item using or including your original wrapper. It should also include all instructions, documents and packaging of the products. No refund will be made if the product has been used beyond the mere opening of the same or if it has suffered any damage, so it should be careful with the products while in possession.

    1. Defective product returns

In cases where you consider that at the time of delivery the product does not conform to the provisions of the Contract, you must contact us immediately, indicating the product data as well as the damage you suffer.

We will proceed to carefully review the returned product and we will notify you by e-mail within a reasonable period of time, if the return or replacement of the same is appropriate (if applicable). The return or replacement of the item shall be made as soon as possible and, in any case, within 15 days of the date on which we send an e-mail confirming that the return or replacement of the non-conforming article proceeds.

The amounts paid for those products that are returned due to any tara or defect, where it really exists, will be fully refunded, including the delivery costs incurred to deliver the item. The refund will be made in the same means of payment that was used to pay the purchase.

The rights recognized by existing legislation are safeguarded.

  1. RESPONSIBILITY AND EXONERATION OF RESPONSIBILITY

Unless otherwise expressly provided in these Terms, our liability for any product purchased on our website shall be strictly limited to the purchase price of such product.

Because of the open nature of this website and the possibility of errors in the storage and transmission of digital information, we do not guarantee the accuracy and security of the information transmitted or obtained through this website unless otherwise expressly stated in the same page.

All descriptions of products, information and materials on this website are provided as a true body and without express or implied warranties on them.

With the scope permitted by law, we exclude all guarantees, except those that cannot be legitimately excluded from consumers and users.

The provisions of this clause shall not affect their legal rights as a consumer and user, nor their right to withdraw from the Contract.

  1. LINKS FROM OUR WEBSITE WEB

In the event that our website contains links to other websites and materials of third parties, such links are provided only for information purposes, without us having any control over the content of such websites or materials. Therefore, we do not accept liability for any damage or loss arising from its use.

  1. COMMUNICATIONS BY SCRIME

The applicable law requires that part of the information or communications sent to it be in writing. By using this website, you agree that most of these communications with us are electronic. We will contact you by email or provide you with information by placing notices on this website. For contractual purposes, you agree to use this electronic means of communication and acknowledge that any contract, notification, information and other communications we send you electronically meet the legal requirements of being in writing. This condition will not affect your rights recognized by law.

  1. FULL AGREEMENT

The present Conditions and any document referred to in these terms constitute the full agreement between you and us regarding the object of the Contract and replace any other covenant, agreement or previous promise agreed between you and us verbally or in writing.

You and we recognize that you have consented to the conclusion of the Contract without having trusted in any declaration or promise made by the other party or that you may infer from any statement or written in the negotiations entered into by the two prior to that Agreement, except as expressly referred to in these Terms.

Neither you nor we shall have action in respect of any uncertain statement made by the other party, verbally or in writing, prior to the date of the Contract (unless such a statement had been made fraudulently uncertain) and the only action available to the other party shall be for breach of contract in accordance with the provisions of these Terms.

  1. OUR RIGHT TO CHANGE THESE TERMS

We have the right to review and modify these Terms at any time.

You will be subject to existing policies and conditions at the time you use this website or make every order, unless by law or decision of government agencies we must make retroactive changes in such policies, Conditions or Privacy Statement, in which case, possible changes will also affect the requests you have made previously.

  1. IMPLEMENTATION AND JURISDICTION

The use of our website and the contracts for the purchase of products through this website will be governed by Spanish legislation.

Any dispute arising or relating to the use of the website or to such contracts shall be subject to the non-exclusive jurisdiction of the Spanish courts and tribunals.

If you are contracting as a consumer, nothing in this clause will affect the rights that as such recognizes the existing legislation.
